If you have recently been arrested for drinking and driving in Pennsylvania, you may believe that you will automatically be found guilty in court; however, in actuality, nothing could be further from the truth. The fact is, there are many successful DUI defense strategies that may help you avoid jail time, fines, and a lengthy driver's license suspension.

The first thing your attorney will establish is whether or not the arresting office had probable cause. This means that the officer had to witness you breaking a law, such as speeding, before pulling you over. The officer must have probable cause to believe you have been drinking before beginning a DUI investigation.

Your attorney will then ensure that your Miranda rights were read when placing you under arrest. Failure to inform you of your Miranda rights will make anything you say after your arrest inadmissible in court. This will also apply to the results of your field sobriety tests, if administered after your arrest.

Field sobriety tests are far from perfect, in fact, they are entirely subjective. If you are over 65, more than 50 pounds overweight, or have certain physical conditions, it is almost impossible to pass these tests. Your attorney may be able to argue against the results of your field sobriety tests.

Breath-testing machines are not without their own set of problems. Gum, mints, and tobacco products may inflate your test results. In addition, certain dental and physical conditions, such as acid reflux, can produce inaccurate readings. Your attorney will also investigate whether the breathalyzer was properly maintained and/or calibrated.
